What is the name of your state? MA

My husband is going to file Chapter 7 BK as soon as we can come up with the $1039 it costs to do so (atty, and court fees)

My question is I just bought a new car and he co-signed because he had more income. How will that affect the vehicle and does he have to include it in the BK?

To avoid lawyer fees, how hard is it to file on your own?

Since he is the co-signer on the loan he will have to list the debt in the bankruptcy. You can not keep anything 'out' of a BK, EVERYTHING must be included. He may have to sign a reaffirmation agreement to keep the lender on the car happy.

Filing for BK pro se is not easy. BK is very complicated and filing pro se entails YOU doing all the legal work a lawyer would ordinarily handle. If anything comes up, like a creditor challenge or tough Trustee questions, most people would be hard-pressed to deal with it adequately. Its also worth noting that w/o a lawyer, the BK Trustee is likely to ask a lot more questions and dig a bit deeper.

I know it seems like a lot of money, but it really is better to use an attorney.
