My name is Darrin and i am despretaly seeking your advise on a certian matter .It is a long story ,but i think that you should know everything.12 years ago i got into a little trouble with the law nothing serious but i got a fine out of it and it was against the law for what i did.So anyway i now am paying for it again 12 years later .I met a very wonderful lady From Kentucky ,and we are engaged to be married now here comes our problem .I have a criminal record now which allows me not to enter the U.S.And i want to move there when we get married .I went to fly down there in march and they stopped me at customs and would not let me through .So now they know that i have a record .I did'nt know this before that or i would'nt have tried to cross.So shortly after that i have obtained a waiver to enter the U.S.legally ,and it should pe processed within 8 weeks .I am in the Local Union here in Canada ,and i have been talking to one of the Local Union's in the U.S. and i have a job already to go to when i can get things straightened out .This Lady really means alot to me and we want to be together as soon as posibile .It has been almost a year now ,and it is time for us to be together.So i really need your help ,and also some answers.If there are any questions you need to ask please let me know .My charge was theft under a thousand.Where would the best place for us to get married Canada or the U.S..If i went there legally and got married can they deport me .How long before i can work if when i get there.Should i try and get a visa before we get married and get married in the U.S. or get married and gjust go .

Yours is a tough one.. if you enter on a temp visa and marry they will really dig into your case because of your past. However there is also a slim chance of having a K1 denied...

Personally I would try the K1. It is unlikely that a non violent offence would stop you getting your visa.. but it does take 3 months...

A K1 is a petition by your g/f to bring her fiance into the US for the purpose of marriage. It takes 3 months (generally) to obtain and results in you having a visa to enter the US and marry within 90 days. Once married you can then Adjust your Status and apply for a proper residential visa with work authorisation.

If you enter on a tourist visa and marry you can still Adjust your Status but you will be investigated more closely and there is every possibility that your adjustment is denied on the grounds of fraud.

K1 is he correct route when an american wants to marry an 'alien'.
