Once you get married, you could petition for a green card for him from INS. However, they have the right to refuse him entry.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.
I will try to give you general guidance and point you in the right direction, but only a lawyer licensed to practice law in YOUR state who is serving as YOUR lawyer can provide you "legal advice" to rely on.

If there is any evidence that he was in the US illegally then he will not be allowed back in. So, basically, he needs to sneak back out without being caught. Then you marry and have to file I130. As part of that application he will need to fill in a G325, he will have to lie on this form.. I am not going to go into the implications of being caught.

Wait for up to a year.. he gets a visa, a green card and then you live in fear of being caught for many years..

Good luck.
