"What I believed I paid for." Yeah, right. If an item is not in a bag, it's stolen. You're going to the slammer, kiddo.

how many times you purchase something and you don't need a bag and walk out without bagging? so it is a crime if there is no bag, please don't shop at Costco they don't have bags there!

I am not a thief. I am not worry cause I did not steal anything. Don't ask me why the cashier bag this and did not bag that.I did not pay any attention for bag or no bag.I just took what I paid. I walked out of the store not ran out with my 3 kids. Why didn't they stopped me right away if they see me taking something didn't pay for? I am glad you not my lawyer or I go straight to jail.

My response:

More like, go straight to "hell".

Sure, I'd take your money and attempt to defend you. However, once that surveillance tape is shown to me, and you, you'll be begging for the least amount of jail time.

Why didn't you take all the other items in the check-out line? Like the gum, and the batteries, etc., while you were in line? Was it because you hadn't paid for them? Note to self: "If it's not in a bag, it's not mine to take."

Oh, please! You're sob story just isn't going to make it. You never did answer how long you had to concoct your story.

My response:

Oh, that's real good logic!

Do you think the two stores being set up differently might have something to do with your logic?

Ladies and Gentlemen of the Jury . . .

You have heard evidence that KIMPO made a statement in the presence of the contributors of FreeAdvice that Kimpo failed to answer a question put forth. You have also heard that Kimpo did not deny the statement.

You may treat the silence of Kimpo as an admission that the statement was true only if you believe all of the following conditions are true:

1. That Kimpo was aware of and understood the statement;
2. That Kimpo, by either words or actions, could have denied the statement but he/she did not; and
3. That Kimpo would have denied the statement if he/she thought it was false. In determining this, you may consider whether, under the circumstances, a reasonable person would have denied the statement if he or she thought it was false.

If you do not decide that all three of these conditions are true, you must not consider Kimpo's silence as an admission.

concoct what? I don't need to cause what I said is the truth. I will repeat again and again what I said. I did not take other items cause I did not pay for those item. Don't look at everyone like a criminal big shot lawyer if you really a one.

curious

i don't have an answer to your legal question, i do have a question for you though. do you know how they figured out that you wound up with 3 more movies than you paid for? it's highly unlikely they did a storewide inventory that evening and realized there were 3 movies missing from the shelves, then figured out which ones they were, then watched every minute of film from that day to see who picked those movies up then followed the trail from there. some how, some way, they knew you had them and didn't pay for them even though you thought you did. sounds fishy.

Did it never occur to you to say "Hey - did you get these?" regarding your three dvd's? Or when you discovered that you had two dvd's you shouldn't have - you didn't check the receipt? And then figured it was okay to wait a week before doing anything about it all? Okay, you work. Have you heard about that nifty invention called a telephone? It lets you talk to people when you can't go see them in person. Something about your story just don't jibe.

I AM ALWAYS LIABLE, your question came off rude, maybe he didn’t want to get into a shouting match with you. Second off I can tell you have no trust for anyone or anything nor any respect my friend. Why is it upon this guys post he nearly got jumped. This really says a great deal for the society we live in now days doesn’t it???

Personally I believe him, you can think I’m ignorant/stupid/retarded or what ever you would like but that is your opinion and you are entitled to it. I’m sure at one point and time in our life’s we have all made mistakes such as the one this guy has made.

As far as jail or prison time go, you charges will most likely be dropped to conversion and you will have to pay the store which the merchandise was mistakenly taken from either 3x(products price) or $300, most likely $300. Afterwards the charges should be dropped and the odds are you wont have a record, unless you were arrested.

Almost forgot, most stores will let you off at $200 if you pay it in 30 days!

The case of the DVD's...

Okay, I have two questions:

1) How many DVD's were you charged for (on your credit card)?
2) How many DVD's did you have in total when you got home?

From your original post, I figure that you ended up with only one DVD that you didn't pay for. Is that correct?

I doubt VERY much you are going to go to jail over this. The problem is that you should have immediately gone back to the store to straighten out this mess the day it happened.

You sound like your the one that needs a lil of the good old Bubba loving in your life. Might help ease some of the stress from all your clients that you have let down in one way or another. You and Bubba would just make the perfect couple, Bubba likes to force foreign objects into to people. You like to force your opinion in people. Bubba likes to braid butt hairs. You have lots of butt hairs. Bubba likes to spank you and set you straight, you like to do the same but not physically, but mentally. See you and Bubba are a match made in heaven!

And yet no one believed me when I said it was a bad idea to give internet access to the computers at mental hospitals.

Hi I am the guy whom you believed and thank you. The police never charged me once they watched the video tape from the DVD store. It took almost a month and a half for them to investigate. To me it was a good experience, I learned to be more careful now. Anyway thanks again.

I believe it was a mistake, I do not believe you are a thief. You won't go to jail, get a court appointed lawyer if you can't afford one.

4. Kimpo regarded your question as so ridiculous that he didn't bother to validate it with a response.

Why do you act like such an assbag? Cops always come to someone's house threatening to arrest someone for this or that to satisfy their power trip.
I sure hope you're not a lawyer anywhere near I ever live.

Oh yeah, did you read the last post?

What did you say about how he'd be begging for the least amount of jail time once the DVD is viewed?
