father of child on this state birth certificate welfare aware of parenting. do I need to get actual paternity test if father not contending to facilitae next question and 2. work visa expired returning to Mexico(father) wht do I need do help get visa as parent of U.S. citizen (infant) to be able return legally 3. can i do this self or need lawyer???

A lawyer would really make it easier, faster and more likely to get you the results you want. There are just too many chances to make a mistake on your own.

I do not follow what you said about the parent situation -- which is another reason a lawyer makes sense. If you can't effectively communicate your chances are way less.

I also do not follow your post.. but I can tell you there is no provision for an alien to come and work in the US just because they have a USC child. They either have to marry or get a work visa by other means, eg, H1B.
