I live in California, my ex-husband and I have joint custody (legal/phyical) but they live with him. What are my rights to the children.He makes all the decisions and dosent inform me of anything. Do I have a say so in anything theat goes on with the kids?

Helpless mother in need of advice!!!!

What does your court order state? Is it spelled out somewhere within, what your rights are? I saw the definition of joint legal/joint physical in another post here, but can't remember where it was now.

If you have joint physical and legal custody- why do the children live with him? Joint physical means the children live alternating with both parents. Joint legal means you both have to agree/consent to major decisions such as educational, legal, medical.

What types of things are you not being informed about? You need to be more specific ie; if he's just taken them to the Dr. for a cough it's not a huge deal. If he's scheduling un-necessary surgery that's another issue.

You already have the right to all their school and medical records by contacting the school and Doctors.

She must mean that 'they' have 'joint legal/joint physical', with 'him' having been designated 'primary residence'?

That's how 'my' son's order states it. Joint Legal/Joint Physical...Father with Primary Residence.

The court papers that I have do not state in the papers that he is the primary care parent. It just states we have joint legal and physical custody, with me having visition rights. But they have been living with him since the divorce.
