Back in August 2004, I was involved in a car accident. I wasn't to blame for the accident...but, I didn't have insurance. I cancelled it that morning because I was selling the car that evening....I know what a dummy I am. Anyway, the guy who hit me took my information and he gave me his. No cops showed up while we were there. He said we could go to the police station on our on time and fill out accident reports. Since I was leaving the next day on a plane to PA, I didn't have time to go to the police station. Now I am being harrassed by his insurance company to pay for his damages even though I didn't cause the accident. I payed a fine I received from City of San Jose Police Department for driving without insurance because they found out about the accident. I have a witness who saw that I did not cause the accident. Do I still have to pay for this guy's damages?

I am in a very similar situation right now. I was uninsured and my car came out of gear and hit 2 cars. One vehicle was insured and the other wasn't. The insured was through State Farm. They are coming after me for money. I think u can set up a payment plan w/the insurance company. They usually just turn it over to a collection agency and then u set up the payments. If the accident wasn't your fault though I don't think u should have to pay. Don't let the insurance company bully you b/c they will definitely try. I think u should stand ur ground on it since it wasn't your fault. Maybe u could set up an appointment w/an attorney and just get some legal advice to know if they can pursue this. You definitely don't want to pay that if they have no rights to make you. Good luck.
