I was rear-ended, guy had no insurance. I have pictures of the accident, know where he lives and have pic of his ID and text comversations about the accident. I already had car repaired, now he is dodging my texts and calls to pay for it. I am going to sue for the cost of repairs, legal fees, and can I also sue for time spent out of work to go to three different autobodies for estimates?

You could sue for it, but it would be denied as not being a proper element of your direct loss or compensatory damages.

The next guy might claim that he was accordingly late for the track and would have won the trifecta. Or your defendant claiming an offset because if you had been at work you would have been killed in the earthquake.

What happened when you called the police to the scene where someone caused an accident in an uninsured vehicle?

Be aware that even if you are awarded the cost of your repairs, you might not be able to collect.

Didn't make a police report. Didn't call my own insurance. The guy wanted to pay cash and now I'm getting the run-around

If you have full coverage, you're better off using that and letting your insurance company worry about collecting from the driver.

Not smart at all. As soon as you found out the other driver was uninsured (which should have been at the scene) you should have called the police and your own insurance.

People like that need to be taken off the road not enabled by having other drivers agree to side deals.
