This is the dilemma, if you don't cooperate they may haul you in. And this officer was a total jerk to everyone there, probably would have; he had a real problem with me not having an ID, had a real attitude about it.

I wasn't aware of the stop and identify statute all of these states have, I just looked it up - although it appears to only be if you are detained under some sort of suspicion of crime, not if there is no suspicion. So in my case since I was trespassing that is all they needed I guess to use this statute.

It appears as if some members of this forum are fascists. So keep that in mind when reading replies.
 


if you are going to be arrested, you are required to have an ID to get bailed out. therefore, you should always carry ID.

I have never required any one to have an ID to bail out. We only have to get positive ID, through fingerprints, if they are not positivly identified. If we required people to have ID's to bail out we wouldn't be able to release half of our intakes.

We also will provide people with ID when they are released, in the form of their booking sheet with photo. Then they can take it to the DMV for a real state ID.
 
Look, in the OP's case he coughed up all the information the cop asked for & now is doubting the cop was going over the line. Hey, anyone can ask you anything .. if you want to accommodate them then that's your choice. I myself just respond "I don't play that 20 questions game" and keep my mouth shut..the cop can yell and scream and urinate all over himself for all I care after that point. (unless its Dick Cheney on a hunting trip).

If someone on the outside can bring your ID, then your good. if not you are down for the night / weekend.

Nonsense. I've had plenty of defendants bailed out with no ID.

(I know they can if they tried, but they don't, or don't say they have done so)

Huh?

they wait for the court to identify you in the morning.

And how does the court do that?
