i filed my chapter 7 and i got served papers for small claims from capital one wich i included in my chapter 7. I called clerk of courts to tell them that i filed and they said that unless an attorney calls them they will still file judgment after 20 days is up. Now what do i do. SHould i call the attorney for capital one and tell them i filed. Any help on this would be great.

Do you have a attorney? If so take the order to them and they will take care of it. But legally if the creditor is on the chapter at the time of filing then they are not allowed to contact you. I had a couple of them that I had to bring that up to them over the phone that it was against the law for them to call or have written contact with me and I gave them my attorney's phone number. Then I contacted my attorney.

If you are still within the time limit to file an answer on the Capital One lawsuit, you should file an answer and the answer should include that you have filed bankruptc, and the date, and the case number. I hope you put Capital One in your bankruptcy as a creditor. If not, you need to amend your bankruptcy and add them as a creditor. The court charges $26 to add a creditor.
