What is the name of your state?Florida

When me and ex went to court for a contempt hearing, somehow he was able to bring visitation up. The judge ordered that he get my son every other weekend. He has shown up the first two times that he was supposed to get him. He didn't show up yesterday and we waited for 15 minutes after the time he was supposed to get him (at the agreed meeting place). Is there anything that I need to do? Am I supposed to go back in 2 weeks to see if he is going to show up? My son's feelings was very hurt yesterday. He is only 6 and was expecting his father to show up.

Well, if it were me, I'd first call Dad to see what happened. But yes, if you're ordered to have the child available - you have to go back each time. If there's a pattern of not showing up, you can petition the court to either modify the visitation or put in a clause requiring him to contact you w/in a certain timeframe to let you know if he will/will not exercise that time's visitation. And you may also want to clarify how long you need to wait - 15 minutes isn't that long. Hopefully you can prove that you were there.

I don't know what the law is in Florida, but in my state, each party has to give the other party 30 minutes. If he doesn't show up in 30 minutes, then the time has been forfeited for that day. You only gave him 15 minutes and if he showed up a few minutes later and you weren't there, he could possibly file a contempt charge against you for denying visitation. I don't know what the relationship is like between you guys, but maybe it would help to call and find out why he didn't come. That way, if he did show up after you left, you could try to smooth things over before he has the chance to file a contempt charge against you. Believe me - contempt of court is not pretty. I was facing two charges for denying visitation. The judge told me that I withheld visitation one more time, then he was automatically going to transfer custody to the father.

I would like to add to the other responses....it would be best if you get some proof that you were there. It can be as easy as buying something (right before you give up and go home) as long as the receipt has a date and time on it.

Ideally something when you arrive, and something when you leave.
