What do they do when you are behind?

What is the name of your state? NC
I was wondering if anyone can fill me in on what happens when you go to court for being behind almost $5,000 in child support? My fiance has a son that he had been paying support for, he got in an auto accident and was out of work for 5 months. He has been trying to catch up, but is still behind. We have a 7 month old baby together. Do they automatically put you in jail for this, or do they work something out so you can pay it back? His court date is Tuesday.
Also, my ex. husband is behind $1000 and they haven't done a thing to him. Any advice would be helpful.

It depends. I'm not sure that I'd be worried about jail time at this point, but he can certainly expect that he'll be assessed an amount in addition to his CS for the arrears. At $5k, his license could be at risk, as well as a passport if he has one.

**A: he should be paying cs for his son before paying anything for the baby.
After all, the son came first.

Most likely the judge will verbally warn him about being a responsible parent, and then give him a reasonable time to pay the amount.........When I say reasonable, I mean.... whatever the judge feels is reasonable, and some judges think you can build Rome in a day.............Others give all the time in the world it depends on their mood.......... I hope his accident was serious. because if he broke a nail, and took five months off..........The judge will not be a happy camper...................

In the case of my ex who was behind $10k, he was put on probation for three years. During that time he can't miss a payment or quit is job otherwise he goes to jail and work release. He also got an extra $100 added per month, that'll only take over 8 yrs to pay off interest free. :rolleyes:

I agree with you on the first part.
Secondly, no I haven't heard anything from my ex.'s child support case. I filed paperwork months ago, and haven't received anything. When I call up there, all I hear is how busy the child support system is and they will get to my paperwork. I can see how some people get behind in child support now, because if they take this long to recognize paperwork, heck, how long will it take them to recognize payment?
