I was just looking over last custody papers and it states the parties shall share joint legal custody and defendant BF will be the parent of primary residence. that order was 5-4-00. now the children have lived with me since 5-01, we havent gone back to court and child support has never been an issue . i wanted to modify the court order so it says that i have primary physical custody and establish child support but when i went to download the papers it says if docket # begins with FD i cant why not?????? Please someone help!!!!!!! Thanks

IN NJ.... I cannot answer about the FD question but Iam curious is the BF suppose to have residential custody all this time and you MOM have the children now? Also be prepared that when you go back into court that the original custodial parent will more then likely want the children back as the court papers say. Next can you prove they have been with you all this while not that it is he said she said argument.

I guess the only thing you can do is go to the Court house in the county that issued the last order, and have it modified. Forget about downloading it, just go in person and file. I never tried to download any info, as I always went in person and filed. Good Luck!

yes i can prove the kids have been with me. He really doesnt have anywhere to take them so im not really worried about that.The kids are registered in the school district where i live and they both get straight a's they have plenty of kids to play with and its very stable for them here. thanks for your help.

My daughters have lived with me since may of 2001 , ex had to move out of where he was living (hotel). so we decided best place was with me i got into a very nice new apartment and actually he stayed here for a while. while he was looking for someplace to live. i have been more than nice to him because he is the father of my daughters and i cant leave anyone out on the street. but being nice doesnt buy food and clothes and pay rent. all i ask for is $100 a week from him and thats like a project. and that little bit only pays for babysitter. i dont make alot of money i went from being a full time mom from 18 to husband changing locks and telling me to get out. didnt know where to go but 2 1/2 years later i have a pretty decent job a nice house and my girls. i just want to keep it thats all i dont want alot just a little something to take car of our kids. sorry i ramble alot. thanks for listening.
