What is the name of your state? Florida

I just had my 341 Meeting for my Chapter 7, no asset bankruptcy. The Trustee was very thorough and wanted copies of my bank statements for the last year and the purchase agreement for my wife’s car. She is not included in the BK. No creditors were present. It was a humbling experience.

What happens now? During the meeting I felt I was being given the proverbial third degree. Will the Trustee go over all my records with a fine tooth comb looking for omissions? Will she contact my creditors to confirm my statements? My only income is disability and my lawyer is confident I will receive my discharge within 75 days, but I worry some unknown and unintentional oversight will cause problems.

I would appreciate some insight into what a Trustee does after the 341 Meeting.

And I would like to thank all members of this Forum who took the time to answer my questions during my decision process to file BK.

FL has some very chintzy exemptions except for the homestead exemption. If anything, the Trustee might look for non-exempt assets or anything above the lousy $1000 exemption. Most of them have neither the time nor the staff to examine every debtor's papers in any detail. Its likely you won't hear another word until discharge, but they ask for the papers anyway.

Thanks, Ladynred

Thanks for the comforting words. I am not worried about the Trustee finding anything. I just want the ordeal over with.

along these same lines...

Georgia

We just received a letter from the trustee wanting the bank statements, itemization of personal property, household goods, etc...(do we list everything in our house??)
What form do we use to submit these?
Will we have to go back to court? We did this proSe, is it too late to hire a lawyer or do you think we can see this to the end ourselves now?
We have nothing to hide we just filled out the papers leaving out specifics.
Thanks for your help.

All of that household furnishings info should have been on your original schedules. If you're not sure what form the list should be in, call the Trustee's office and ask. If you listed personal property and household goods on your schedules, you must have been very vague.

Book: How To File For Chapter 7 Bankruptcy

NOLO has a book called How To File For Chapter 7 Bankruptcy by Stephen Elias that includes detailed information on how to fill out the forms and how to file without a lawyer. I was able to obtain this book from the library on interlibrary loan. Get the most current edition you can (11th edition came out May 2004). The 12th edition will be out in a few months.

p.s. They also have How To File For Chapter 13 Bankruptcy
