My wife has a previous child with someone that lives in Florida. She was wondering, seeing that he has not paid child support in just under a year. What happens to him while he lives in florida?
Is his license removed? Is a warrant issued? How much is too much before they take more stringent actions and what would those actions be? If he is arrested, what happens to the money he owes? He works "under the table", so there is no documentation of his wages so florida cannot take the money from him. She used to receive a small amount of backed money around income tax time, but were worried she will see nothing come income tax time this year, due to the fact of not receiving any payments in the meantime?

Where was the court order issued from? FL or IL????

Im pretty sure its in florida... But i know they have already, taken income tax and sent money. I know they have docked unemployment wages to send money. But that is as far as i know at this point.

Thanks for the info and id like to see if there is a writ on the case also.

I just double checked with my wife and its court ordered in FL... We checked the local court records and the case has been "reopened" as of 6-2010??? But there are also tickets for driving while license suspended. So im assuming they have done that also?

It's good that there are some inroads on the case. However, the sad truth is that if a noncustodial parent is determined not to pay then it is very difficult to collect. Some parents do not care if licenses are suspended, etc. One of the things we advise custodial parents is to make sure that they are able to support the child(ren) without CS - because it may happen that it delayed indefinitely.

We are by no means rich, and we both work very hard. Im also starting school again to further my education... We do take very good care of our children, and the money isnt needed but helpful when there.

We dont "rely" on the money, just wondering what is happening to him on a legal side while we are so far away. And if she needed to contact the authorities about his nonpayment or is it being handled?

If Mom went through CSE, then likely it's being handled. Interstate cases take a while, however.

Most likely the case was reopened in June because the DOR CSE is in the process of enforcing the order. Does the docket mention any filings for a "notice of delinquency", "certificate of delinquency" or a motion for civil contempt?

Your wife can contact the DOR to see what the status of the case is.
