What is the name of your state? NY

What is a temporary order of support mean? Our lawyer indicated that is what the judge might do at the initial hearing on October 17th.

It means just what it says. Support in a temporary form either for a child(ren) or spouse.

Okay, sorry about that.

My husband has been summoned to Family Court for a modification of child support. The so called "child" in question is 20 years old. He is going to emancipate in less than 1 year from now and his mother is asking for a modificationin support for car insurance, clothes, food, etc.

The "child" has a full time job and earning about $24,000 per year. His mother has let him go into about $20,000 in debt for a dirt bike and a 4 wheeler. Not real responsible if you ask me.

Anyways, we have hired a lawyer and have given him all the paperwork. We are going to try for financial emancipation. But he said the judge could possibly order a temporary order of support and I was merely asking what that meant. I guess I don't understand what good a temporary order of support would do, if he doesn't have all the facts yet.

I spoke with our lawyer today and he is putting an answer into the mothers petition. It just is very frustrating for my husband, he is a good father.

So there is already a Support Order , X is Petitioning for modification increase .

IF the Judge orders a Temporary ( look up the word's definition - means the same in this legal sense ) , the Judge may order a Temp. increase , or decrease , or may find the kid fully able to support himself , and terminate the CS obligations altogether .

The Lawyers don't really know . They put the Petition, and answers in front of the Court . No one has a magical ball .
