Its really strange that they are not willing to execute the order for wage withholding, that is usually what they prefer to have done.:confused:

Yes, you can petition the court yourself. However you shouldn't have to if I understood you correctly. You said the orders already included a wage withholding order. Therefore it should just have to be executed. Do the agencies understand that?

Before I was shut down (by WY agency), I was very verbal (without being abusive) about requesting that the wage withholding order be executed. I've researched civil procedure, but from my point of understanding, its muddled and confusing.

Correct me if I am wrong, but;
1) as with any other motion, a respective perspective order has to be included,
2) need to include the portion of the relevant paragraphs you wish enforced
3) copy of the original order (does this include the motion since the order only references the motion for specificity)
4) service to all parties involved; respondant, court, agency

Service question:
1) service by personally and in person, or by certified mail signatory by addressee only?

Why would I serve my ex about a wage withholding, giving him the opportunity to quit his job?

It sounds like you have it right, although I am not specifically familiar with the court rules and proceedures for whatever county applies in your case.

You have to serve your ex regarding any court action of which he is a party. That is the law. If he quits his job that just means that he would have done so anyway, after the first paycheck where CS was withheld.

The reason I asked about serving my ex is that I don't remember specifically, but I don't think we served debtors when we intended on garnishing wages or bank accounts...
