Unfortunately, when someone remains in a situation that they know is volatile they can get caught up in a world of trouble. He may have a deep hole to climb out of here. But to have any chance at all he's going to have to go to trial on it and make the state prove its case. A private attorney might be best to mount a serious defense, but if he cannot afford one he'll have to direct his public defender not to deal.

Since I am not aware of FL DV law, I can't really offer any suggestions or ideas, but I imagine he can prevail ... it will just take some effort and a lot of lcuk.

any help you have given me is more appreciated than you know, its hard to see someone in this situation knowing you are as helpless as they are.. its hard to believe that lawyers dont run based on income to defend in such cases. he just keeps saying its a lose lose situation. i just hope this girl faces god one day. at 23 years old she either is one smart lil girl or has someone giving her the ideas. either way... hopefully what goes around comes around

Procedure To Talk To The Da ?!?!?!

since i could be the missing link in this case is there a way i can talk to the da handling this case?

after all i was on the phone while all of this supposedly happened. can i go to them and tell them my statement of what happened to get him off the hook or is that like a lawyer thing where they only talk to one side?

I would not recommend talking to the DA unless your friend's attorney okays it. While you may think you are doing some good, you could actually torpedo him.

ok and another option is..

a deputy said i needed to talk to the arresting officer to give my statement. do you think that would help matters in this case? i still dont understand why the officer i called didnt contact him or merge reports like he said he would. time is ticking and hes got four days left to count down. when he goes in and pleads not guilty will they tell him that day if they will pick up the charges?

Follow the advice of his attorney. I have no idea whether what you have to say can help or hurt. What little you may have to add may be irrelevant or have no real bearing on the case at hand. So unless his attorney thinks it will do some good, I would recommend you don't talk to anyone.

if there was a consequence for people who claim wolf with no evidence maybe it wouldnt be soo easy for people to abuse the system. she refuses to say she lied of course. what a hard situation. anyway, good morning carl and thanks again for your help, youre the best

The D/A will only take that against you, don't do that. Talk to his attorney, you will have to be a witness in this trial under oath, that you heard everything on the phone. If you got your phone bill take that with you in court, show them the time, date, mins on the phone, etc.....also show it to his attorney. That would be a big help in this trial.

ok i told my side and they just looked at me and said it looks like im sleeping with him and lying for him.. huh??? what is this world coming to?!?!?!

and now this woman saw my name in public record and found me in the phone book and does nothing but call me nonstop trying to be my bestfriend after she yelled at me forever on the phone that night. now i know she really is bipolar. im not answering my phone anymore! :confused:
