You do, of course, realize that until you establish residence "there", all custody and divorce related legal matters will have to be addressed in NYS, right? So your lawyer "there" is useless until that point.

So what do you all think??? I"m thinking just to leave in June when the school is out for summer and if I have to come here for court b/c he takes me then I do. Hopefully the judge will see we can have a good life there and since he has no real close family here for him he can easily move there as he did before when I was pregnant and when she was first born.???? Please give advice.
You obviously did not read my response.
Since you have already filed for custody in Ny, leaving the state's jurisdiction without the permission of the court COULD lead you to federal parental kidnapping charges.

Now, feel better?

So I can not just leave the state with her and come back for court as I was told from the lawyer. So can anyone tell me what to expect at the first court hearing I will be given for custody, will it even touch on moving? Or just custody?

Did you ASK the court to allow you to move? If that is not in your current petition for custody or your AMENDED petition for custody, then no, not without facing problems down the road.
