What is the name of your state?
Arizona

In July we took over the mortgage of a "friend" who wanted out from under her mortage to move to Michigan. We signed a land contract with her and took over the payments. Thus far, we are two months ahead. Now she has filed bankrupcy, we have received notice, and we have sent a copy of our contract and proof of payment to the Trustee.
What legal rights do we have to protect our investment now.
The property is in AZ. and she filed in MI.
Notice I put "friend". Now she won't even get in contact with me so we can obtain copies of mortgage payments. How do we know if she was paying prior to our purchase? And again, what legal rights do we have?

Just to clarify, did you make the payments to the bank (or to your "friend")?
And did an attorney draw up the land contract and was it recorded with the county?

You need your own Atty NOW. Was the loan an assumable loan? Did the mortgage company APPROVE of this transaction?

You are in the land known as "things that can and way to often do go very wrong with LC's/contract for deed".

Please do not be doing or sending anything anywhere without benefit of an Atty!

Have you done a title search on this property, I suspect if you did right now you would find there are a few other claims against it?

Atty now and one versed in real estate matters.

Do not be surprised that even if you end up with the property you might face the prospect of the balance in full being due.

when you said "took over" do you mean you just basically make the mortgage payments for her? Can I be your friend?
