Take what visits you can get ,till you can get something official .

At this point you need court orders. Until you do, the time you spend with the child is at Mom's discretion. It WAS foolish to force the issue of her picking the child up to a call to the police - she's unlikely to make the "mistake" (in her eyes) of allowing you another opportunity to keep the kid. While BL says it was morally wrong of her to use you, that has little to do with the law. You have to be patient and wait for orders of some sort. You could also kiss Mom's a$$ a bit and see if she'll let you spend time with the kid.

so ijust wait, mother is past kissing butt, i have given her money, bought all the diapers, groceries, before last sunday, is there any advice on what to do at mediation? I know not to make it about who is right or wrong, i have everything documented, i also have the police report from thaT NIGHT. Should i use it in court, also can i tape phone conversations? Every time i talk to her she gets very nasty, swearing and hanging up on me, while our son is sitting next to her.

My husband has custody of his daughter because the mom is worthless.

No one should be bashing anyone. One thing you need to do is file a petition for a visitation order. You two will most likely need a mediator as well. Do not settle for less. Do not let her bully you around now. Your son is as equally yours as it is hers. Go file!

i have filed,yesterday. what i would like to know is it legal to record phone conversation in ohio, and is there anything anyone can tell me about mediation, should i make sure i have court appointed attorney for that, or can it wait for trial. I say that because, i do not believe this will be solved at mediation. Also I picked him up today he is currently napping,. but at least she allowed me to see him, also i hadsforgotten to give her the notarized statement declaring that i would agree to her terms, ( 1hr. a week, everyother weekend), i spoke to an attorney and he told me to give it to her, she is using it as blackmail. Right or wrong? senior members?

Well I am not a senior member but don't give her that she will use it against you and you don't get a court appointed attorney in family law cases. As for taping I am not sure. I would ask for primary (as you did) but if you don't get it go for 50/50 week on week off, if you can't get that go for EOW and one overnight during the week and 2 weeks in the summer along with every other holiday and on three day weekends be sure to ask that your weekend either start early or move into monday (whichever applies) also ask for first right of refusal which means if she needs a caregiver she has to ask you first (that would go the other way too). I would say the year a parent has x-mas that parent gets the week before and the other parent gets the week after to include new years eve and day. Also try to work a week in during the spring like the parent that has easter that year gets the child for the week before easter. Ask for twice as much as you want. But remember that if you do get primary that the visitation schedule you suggest will then be given to mom. Good Luck

The notarized Statement of visitations means diddly squat legally ,as I told you before . You could give it to her . It is not necessarily blackmail .

#1 ) All that statement will show is that you will have had regular visitations. It will not in anyway preclude you from asking for more .
As a matter of fact , even if the Mother has no obligation now to allow you visits , by not promoting a healthy relationship with your child , and using a statement like that , may go against her in the end , depending on the " Attitude " of that party .

I'm glad to hear you are visiting your son , do so every chance you get .

If you are planning on using a Lawyer you should use one throughout this process.
