i reside in texas. my son was born and his father filled out the peturnity paper and is on the birth certificate. i have been told by several diffrent lawers that he does not have any rights till a court order, and some tell me that he can take the baby any time he wants. he is 4 months old and has seen his father 3 times, all in the first few weeks. so there is no relationship astablished. he wont drive to see his son instead tells me to drive there. he has not helped with support of any kind. what are his rights to the child, if any? im not sure what to belive. please help

unfortunately he has all the rights as you. i consulted a lawyer with this question as well. my children are school aged and without a court order with specfic reasons like abuse, violence etc can be established he could come get them. i even filed a police report because he threatened that if my daughter comes up missing i'll know why. the police stated if i have no court document i could call them but they could not make him give her back only ask that he does so for the child's sake. and we as mothers, in my opinion have to kiss butt, so when we do go fight for sole custody, we have to prove we are the responsible one. meaning you will have to take that drive and drop the baby off and proably have to pick up as well. go to this web site it has helped me understand what the judges look for when it comes to what's in the best interest of the child
