What is the name of your state?CA
My friend D's 12 yr old was killed along with her grandmother (D's mom)over 20 months ago in a car accident.There has been no distribution of ins monies for any of the 3 cars involved.
X was ordered to pay child support 10 yrs ago.He moves out of state. Not a dime did he ever send.
Now X wants his share of the ins money. He raises a stink and now the DA wants to take 3 yrs of welfare money ( from 10 yrs ago) plus penalties and intrest out of the ins money.
Will DAD really get a dime?
Can the DA's office pull this crap?
Is anyone watching these people who claim to go after "Dead beats'"?
What is wrong with this picture?

Can Dad get his share? Of course he can. Just because he hasn't paid child support doesn't mean he loses his rights. And the DA is correct that back support (in this case, in the form of state aid) can be recovered from the settlement.

Since it sounds like mom was on state aid(and you never said anything about this issue) then it's perfectly legal. Mom or mom's estate needs to recover the back support owed from dad's share of the settlement.

That's why attorney's get paid to clean up the mess after something like this. People who are this close think with emotions, not their brain.

You are so right on the emitional aspect. Mom was on aid for the first 3 yrs of Katie's life. Mom went to school and made a great life for the two of them. He (DAD) saw her once in 10 yrs and actually talked to her once or twice.
There is a court case pending thru the DA for the "child support" on what would have been Katie's BDay. Isn't it ironic. Thank you for your reply,
even if it's not what I want to hear.
