What is the name of your state? Ohio

When my child was missing for approx. 3 months (she was abducted and recovered in New York,) her father requested a refund of the child support he paid while she was missing. The Judge granted his request stating I did not support the child while she was missing. It didn't matter that I still had fixed cost, the rent to maintan a home for her. Or that I paid $2500.00 for a private investigator who found my daughter. Does anyone have any relevant history or comments? Thanks.

**I agree with the judge here because you'd have to maintain a home whether you had a child or not.

**Well, I'd like to think your ex would voluntarily help you with that cost, and I'm really glad your child was found. But I still agree with the judge. How about asking your ex to kick in some of the costs for the PI? Give hima copy of the bill.....see if he'll help.

I agree with VG. Having transportation and a place to live is not dependent on having a child to support. One does that when they become an adult, whether they have a child, or not.

My mortgage payment and property taxes didn't get higher when my daughter got here. They remained the same as before I became her mom. Having my daughter doesn't change the need to pay for housing, it changes what I spend on clothes, food, camp, doctors and education, etc. Housing is a given, child or no child.

I agree with the judge too. I'm VERY glad that your daughter was returned safely to your arms. Isn't that good enough. I mean for God's sake. Your daughter was kidnapped and returned ALIVE. Why would ANY decent upstanding parent B*tch about some stupid thing like 3 measly months of child support.

If money means SO much to you, drag your ex back to court and tell the judge that you want him to split the cost of the PI with you.

If it were my child that had be abducted, I wouldn't worry about such small things. I would be thanking God every day of my life that he returned her back to me. I wouldn't make such big deals out of stupid issues.

Glad you got your daughter back!

I am certain child support and whether or not you should keep it was the furthest thing from your mind, but the judge was correct in what he ordered.




Now if you are worried about coming up with that money for three months, I would suggest once you get support from your ex just handing it back. Get proof you turned it back over to him. Do that for three months and you are clear.

Thank you for your comments. I appreciate your replies. And as much as I hate to admit it....you didn't say what I wanted to hear, but it was what I needed to hear. I was just so mad I couldn't let it go. Here's a father that has completed abandoned his daughter for the past year and a half--he would not even except her phone calls and now the court was saying he could financially abandon her as well. And now he knows he will benefit (financially) if she disappears again. Once again, I really did appreciate your candor. Sincerely, Carrie

Yeah, what happened? Is it too nosey to ask where she went, and what happened?

By the way, although I understand everyones reasoning here, and the judges, I still think it sucks. What a loser this guy must be, and shame on the judge for siding with him. Just my opinion. :D
