Husband, mother in law & self owned home as joint tenants for 15 yrs. 1/3, 1/3 & 1/3 each. 2 years ago my mother in law wanted to sell her share of the property to use $ for retirement. Instead of selling the whole property my sister agreed to pay my mother in law $160,000 for her share in the property 1/3. She gave an initial dep of $50,000 in 9/02 and $94,000 in 2/03 but was short $16,000. Still has never paid balance. At the time mother in law had already moved into new place. Quit Claim was filed and mother in law was removed from property. Sister supposed to be put on. Sister tells us she has $50000 debt to IRS the day before the quit claim is to be filed. Sister agrees not to be put on deed at this time. My husband and I are the only one listed on the deed. Now sister is sueing us for 1/2 property saying that we refused to put her on deed. We think the IRS caught up to her and she has no money to pay. now she is suing mother in law for $229600 & us for conversion. HELP!!!!!

and it is a case she could very well win. So, I suggest you consult a RE attorney locally and plan on refinancing to pay off her rightful share.

She agreed not to be put on the deed. It has always been agreed that she owned a third of the property. No disputes from us on that. She is now claiming she owns 1/2. How can she own 1/2 when my mother in law only had 1/3 to convey. We offered to sell the property and give her her 1/3 but she contacted a lawyer because she wants more money obviously because her debts to the IRS has increased over the 2 years that she has been here.

These two statements are contradictory; how, pray tell, is anyone supposed to know she owned a third of the property?

A: Sounds like to me she has 1/3; I couldn't tell you why she is claiming half.


Time for a real estate attorney; you have an incredible mess on your hands.
