we are going to put an estate house up for sale so we don't have anything yet. the realator i talked to said that we the sellers would have to pay to get all the test done. i asked some friends who have bought houses if they paid for these tests and they said yes. (ours was put in new so we didnt know)

p.s. beings its the same realator from my post on the real estate forum i'm going to talk to a different realator see what they say.

**Everything is always negotiable between the buyer and the seller, however, it is common that the seller pays for the title search and the title policy.**

I can help you with that. :D

Souix is right in that it's negotiable between the buyer and seller. There is no state law in the union that requires one or the other to pay for title searches and such.

The main deciding factor is whatever is common in your particular area. And there may be many different areas of varying practices within each state.

Example, if it's considered common for buyers to pay for building inspections, then that strengthens the seller's position in negotiations. And vice-versa.

everyone i have talked to thats bought houses paid for the tests. one of them has bought an estate home and they paid for all the test.

**A: back to my post. Does not the answer to your initial question remain in the contract to purchase? Did you read the contract? Please let us know what is says about which party pays.

*** The CORRECT deciding factor is.... whatever was agreed to in the contract.
There is no such legal position as "whateve is common in your particular area".

My response:

I love this one!

Our writer is, obviously, an inexperienced home seller. So, what would you have her do to determine "whatever is common in [her] particular area"?

Take a poll?

Everything in a contract is negotiable - - especially who pays for what.

I did answer back. we are going to be putting an estate home on the market , so we don't have a contract yet. and there was a P.S. beings this is the same realtor I talked to for my question in the real estate forum I am going to get with another realtor.
