My husband is working for a company that is about 8-9 months old and it seems as though one of the owners has been shaving hours off the time cards for things that he doesn't feel he should pay them for. When my husband asks to see the timecards to compare with his own recordkeeping they tell him that they(owners wife) automatically shred them as she writes out the payroll checks and so they are not available. They are also not paying any overtime even when my husband works overtime(they give him straight pay). He is going to work for someone else in a couple weeks but we need this job until then, is this an issue that the WA Dept. of Labor would handle?

who should we make the complaint to?

In Ohio we have to keep time cards for 7 years. Any time that he works has to be paid for. It is illegal for the company to take hours off. I believe that he can file a complaint with the DOL even after he leaves, and I would think that the company that he now works for would probably lose a lawsuit if they shredded time cards, but I am not an attorney, this is just my opinion from what I have learned from my job.

I don't know exactly how long your state requires time cards to be kept, but they DO have to be kept, and I can't imagine it's less than three years. Possibly longer. I may be able to find out exactly what WA requires on Monday. Regardless, shredding them as soon as the checks are cut is going to get the company into VERY hot water with the DOL.

mllandrum is correct that he can file a complaint after he leaves, but to be honest if he's leaving a couple weeks anyway I don't see any point to waiting.
