Why isn't mom getting the money I send?

What is the name of your state? MN

My taxes were taken for child support, which was fine with me because at least I knew the money would go to take care of my child. My order is to pay $319/mo. I have the order in front of me if you would like any specific information to help me out with this question.

My daughter is on Minnesota Care and Child Care assistance through the state. When I received my child support statement this month, it said that $511 was applied to Basic Support, and $634 was applied to Judgment for Basic Support. None of the money was applied to Medical or Child Care Support at all. In talking with my daughter's mom, I found out she only received $26 in the month of April.

It was my understanding that the state could only take money applied to Medical and Child Care Support and that all the Basic Support would go directly to mom. How much is the state entitled to take when the child is on assistance?

I plan on calling the child support officer on Monday, but it's Saturday now and this is driving me crazy! I would really appreciate if anyone could explain this to me or tell me where I can find out where my money is going.

She probably got no $$$ because she is on assistance. The state can probably take as much of the support as they want to cover the assistance she is getting. She is probably getting more assistance than you are ordered to pay support, which is why she is getting next to nothing. Apparently the state doesnt think that she should have her cake (welfare) and eat it too (get $319 on top of the welfare).

Of course, there could be a clerical error, so you should call on Monday, but they will probably say since she is eating up so much welfare, they are using your support to "pay back" the tax dollars she is soaking up.

Anytime you rely on the taxpayers to care for any part of your child's well being, they deserve to be paid back.

Paid themselves back so your child could have care. Child care assistance money comes from somewhere you know (and is a form of welfare).....

Definitely call on Monday - though if you could get in touch with your actual caseworker at CSE as opposed to one of the mouth-breathing drones that answers the phone, that would be better.

My state, and other states too, doesn't 'keep' child support as it's paid unless the CP is receiving TANF (cash assistance) they don't 'go after' people for using state insurance or child care assistance at all.

Does Mom get the monthly CS, or are you not paying that?

I don't disagree with any of the responses that you have recieved.....HOWEVER.....there is a delay between the IRS withholding your refund and the refund getting submitted to the state and paid to the CP. If you are remarried and have a spouse who would have the right to contest and file an injured spouse form, that delay could be as much as six months.

Therefore, just because mom didn't get the money in April, doesn't mean that mom won't get the money at all. If you filed your taxes in April, then you are jumping the gun to assume that the money won't go to mom.

You took the words from me LDiJ. Each time my exs tax check has been applied to my sons support its taken a good 6-8 weeks to actaully get the funds and I was told that this is because they need to hold it for a period of time just to make sure no one else has a claim on it too. IE a spouse or another child support case.

Definately call to check on it.
