What is the name of your state?OR

I've been going through a divorce in Washington State for the past year. We reached a settlement yesterday (there are currently no orders in place for any kind of support) but I filed for chapter 7 in Oregon last week.

My wife's attorney just received a copy of the bankruptcy (I don't know where from) and called freaking out saying that now he can't file the divorce papers. My wife has a wedding planned before the end of the year and he said that my bankruptcy puts things on hold until about January.

He asked me to petition the court to get the stay lifted so the divorce can be finalized.

Should I do that? Are there any risks?

And what did YOUR attorney tell you when you asked?

I used legalhelpers.com and they aren't very responsive at all. I included my divorce attorney in my BK so he isn't talking at all.

LOL-looks like you spread good cheer and joy wherever you go!
I'd suggest speaking with a lawyer. This is no longer a routine bk. The big question I'd have-would this in any way put your bk at the mercy of bk reform.

Wouldn't the bankruptcy continue while the divorce was on hold? We have a settlement that written up and there is no property or assets between the both of us.

Yipes! I just looked at all the papers closer and my attorney didn't list my wife. On one of the questions it asks for past addresses and it lists one in Washington state. Right below that question it asks for spouse or former spouses if I lived in a community prop. state (WA).

I just left a message for my attorney about the whole thing but I'm getting worried. Can we amend this? My meeting of creditors is on the 21st.

Is this stuff really bad? Like, going to get the case dismissed kind of bad?
