Will they take income tax check?

I had posted previously that the AG had still not been sent the papers as of yet that my boyfriend was being over garnished from his check for CS. In court it was stated and proven that he was current, but the AG still has yet to correct this problem. He received a couple of weeks ago a copy of a letter that his lawyer had sent to his ex's lawyer basically saying the same thing, that there was overpayment on both medical as well as CS and that the problem needed to be addressed immediately. Well a week later ex calls wanting to know why she hasnt received all the money she is supposed to (his lawyer told him to stop paying medical until they went to the judge since they found out he was over paid by $300). My boyfriend just told her to call her lawyer and have him call his. She then told him a few days later that her lawyer said he didnt receive any paper work regarding overpayment and that it is what it says it is and that he owes her all that money. He is waiting to hear from his lawyer about what he is supposed to do. Will the AG intercept his income tax check and take out what is supposedly owed in back child support if this does not get fixed? And if that does happen, once the error is fixed, how can he get that money back? His ex knows that he is over paying, but keeps that extra money anyway and doesnt say anything about it. So she will most likely keep that large check and spend it, even though she knows it is an error.

When you deal with the AG in Texas, you have to be persistant, otherwise they'll never get to your case. Call them and email them every day, until they set a date for a review hearing. If they still drag their feet, call Austin. There is a very nice lady named Donna in the Public Relations office that knows how to light a fire under their butts.

They will take his tax return if the matter isn't cleared up when he files. Good news is, the AG's office holds the check for 180 days before sending it to her. So there should be enough time to straighten things out before she gets the money.

It's way too late to do anything to intercept any 2005 tax refund.

If he IS owed a refund, he should file all the extensions possible, which will DELAY issuance of his refund check and allow his attorney more time to attempt to straighten this out.

He can call this number: 1-800-304-3107 and see if his refund is scheduled to be held. That number is for the Treasury Offset Program that is used to intercept tax refunds. All he has to do is follow the prompts, enter his SSN, and it will tell him if his taxes will be intercepted. If they are going to be it will also give him the name and address of who is is getting the intercept (CSE, IRS, etc.)
