I want to fight for custody of my 2 children 5 & 7, my divorce was in missouri, the mother remains in missouri, both of my children are being neglected in many ways educationaly, mentaly etc. they come to me in shoes way to small, clothes badly torn or dirty, as well as the children being dirty, her new husband makes 26.00 an hour as well as her when she's not claiming to be sick and on disability, they buy new horses, appliances and other wants not needs while my children suffer, I purchase shoes , clothes etc for my kids but I never see them again and they still come to me in old worn out clothing and shoes that are a size to small, she takes them over to her 2 older childrens father house where there are drugs involved she her self is taking prescribtion drugs that are not prescribed to her causing her to fall asleep while my daughter is home alone with her which in the past while sleeping my son then 3 got ran over by a car, my daughter got into nair leaving a bald spot on top of her head the list goes on, my son has missed many days in school which he is already on his 2nd yr of kindergarten and shows no improvement that he should go to 1st grade, my 5 yr old daughter cannot even sing hers abc's count to 10 or even tell you the shape of a square, I had her evaluated and was told there would be know way she would be successfull in kindergarten and it will only get worse, the mother refuses to do anything, family services tells me all this is in a gray area for them and I need to get an attorney, please do I have a chance to get my kids before it's to late for them, her older children 10 & 13 have already been in trouble with the law, I'm at my witts end
 


Your son was ran over by a car while she was passed out and family services did nothing? Yeah you should get a lawyer and try for custody. You actually should have done it when you son was ran over.

You will have to be able to prove all that you say. You can't just walk in and say that because their jeans have holes in them that she is unfit. You will need to hire a family law attorney. In the mean time, document everything. It may not be evidence, but a judge may consider it. Good luck

you say your daughter would not be successfull in kindergarten, has anyone had these kids tested for developmental or learning disabilities?
 
Well the educational neglect shouldn't be hard to prove. There was probably a police report done when the son was hit by a car. Start getting your documentation in order.

My divorce papers have my visitation set up as normal, every other weekend, holidays, father's day etc., at the time of the incident with my son we were still married so it was not brought up intill she was hot lined by my friend a week ago, the case worker found many things that concerned her but not enough to take the children away she admits the children are not being raised very well & even the school has many concerns both children are emotionally disturbed and both need counseling but of course she won't take them and refuses to let me. She on many occasions has had both of my children in tears by telling them they will be the reason the get kicked out of there home if her new husband finds out she's been over at the older boys fathers house and when she found out the social worker was coming told my son if he didn't clean the house they would take him away, both children were told to tell them she gets up and fix's them breakfast, makes dinner, bathes them every night etc., I tried explaining to my son he needs to tell the truth when people ask him questions, he said Mom will be mad and will hate me

my daughter was tested thru head start to find out what level she was on, afterwards they told me I needed to take her to someone in the psychiatry field to have tested, thru there tests they figured she was on the level of a 2 yr old

if it were me, I would immediatly file an exparte motion to get temporary custody of the children. refused to get medical attention for a child (even counseling) is often times a form of abuse, take pictures of the children when you pic them up, of course don't mention to them how dirty they look, get affidavits from the case worker and the school system, including copies of any communications they have sent to the mother regarding lack of children's progress and their low education level.

the case worker may not have found enough for the state to walk in and take them away, because they don't necessarily have somewhere better,but if the state knew there were somewhere better to send them and a loving responsible parent who wants the kids, I am sure they would consider a change of custody

My daughter has a late birthday so she would be able to go this year, it's not so much that she should of been in preschool, but her mother never sits down and trys to teach her, I as well as my fiance have purchased preschool books and tried to teach her, but only having her everyother weekend I'm figthing a losing battle, my son will be 8 before he gets out of kindergarten he was held back, which really concerned me for him, he is alot larger height and weight wise than most kids his age so you can only imagine what the others kids think, he can only write his name, and still has trouble with his abc's as well
