What is the name of your state (only U.S. law)? Texas

Can an employer make a write up that the deem to make it 3 write ups in one? They did a write up and automatically made it as a final write up when it's actually the first one I've had not third. When asked they said they combined 3 different occurance in the write up making this into the final not just the first. Is that possible?

If you are a member of a union and combining write ups like this is prohibited by your CBA, then no, this is not possible.

If you are not a member of a union, not only is this possible, it's also perfectly legal.

The only time when the "way they did the write up(s) would become any sort of issue is after they have actually fired you. When you have filed for unemployment, and they are trying to show that they had a valid misconduct reason to terminate you, that you were provided progressive discipline to let you know that your performance was not adequate and that you were in danger of being fired if you repeated this offense. A lot of times employers will try to say, "Well, we gave her write ups!" and you find that just before termination, they came up with a cobbled together write up that may combine two or three disciplinary issues into one and was given very shortly before the termination, so there would've been no opportunity for the person to correct this behavior and keep their job.

If you are terminated very soon, file immediately for unemployment benefits. Keep your copies of the letter of warning that you received, plus any and all communications from the employer ( in hard form, not just in company emails, which you may lose access to at some point.) Do your job to the best of your abilities right up to the point when they terminate you. DO NOT quit the job, as it sounds as thought they may be trying to force you out.
