I was given a speeding ticket for going 61 in the 45. The officer gave me a ticket for going 5 over and said I need to get used to city speed limits because they're a lot different. I've never gotten a ticket and cannot afford my insurance to go up. The ticket he gave me had a license plate number not even remotely similar to mine and said I was driving an escape but I drive a g6. Am wondering if he could have pulled over the wrong vehicle and how I should go about fighting this in court. Thank you

Second, what code section is on the citation?

You should go with checkbook in hand.

On the ticket,
did he get the name right?
Did he get the address right?
Did he get the driver license number right?
The driver gets the ticket,
not the car.

In your defense you could say your Honor,
it was the car that was speeding not I, I was merely holding on to the steering wheel for dear life when I was pulled over...:rolleyes:

Well, there are potential defenses that can be utilized when the citing officer gets the vehicle and license plate incorrect. The argument tends to involve the officer's apparent lack of attention to the facts and attempting to extrapolate that if he got such (arguably) glaringly obvious things wrong, then how can we trust his opinion of a speed estimation? Whether such a claim will gain traction or not depends on the court.
