Wrongful termination?

I have been working for an eye care company for two years through a temporary agency. My contracts are renewed every three months and I was let go before the last three month contract expired.

While working there the conditions were a little harsh due to my overbearing boss. I never made an issue with management about him but I have seen several co-workers make issue and have seen all of them get fired.

This last co-worker of mine was not comfortable with my boss and felt that he was asking too many personal questions and would sometimes yell at her for no apparent reason. She complained to human resources and an investigation was started. Part of the investigation was to ask me about what I knew happened with my co-worker. This is the third time in less than a year that I have been questioned by HR regarding my bosses behavior. This time I didn't hold back and decided to speak my mind about my boss. I told them what I thought of him (in a politically correct manner) and also stated that I didn't think that he was treating my co-worker very nice.

Appx. two weeks after the questioning my wife received a call from my temp agency rep and told her to tell me to NOT come in the next day. Basically, I was fired.

I'm still in the dark as to why I was let go and I don't think it was right that my rep. told someone else other than me that I was fired. My co-worker was also let go in the middle of her three month contract. I also found a posting on Monster.com for two postions that my co-worker and I filled and it was listed the same day that we were let go.

Do I have any recourse regarding my termination or should I just move on and forget about the two years wasted?

Just move on. Since your boss's behavior was not unlawful*, terminating you for complaining about it was legal. This was not a wrongful termination.

* Being an overbearing jerk who asks personal questions is not against the law unless the personal questions were sexually explicit and thus constituted sexual harassment.

I didn't complain. They asked my opinion. Can anyone other than Beth reply with any help. Thanks for your help Beth...but you should really go look for a job now...

Move on.

Unless the behavior you complained about was ILLEGAL (not unpleasant, not unethical, not immoral, but ILLEGAL) AND your state provides "whistleblower" protection for INTERNAL complaints (most do not - in the majority of states only complaints to the appropriate regulatory agency are protected), then firing you for complaining (assuming that is actually what happened) is not illegal and gives you no legal recourse.

While I agree it would have been better to give you the news in person, no laws were violated by giving it to your wife. Nor is there anything even remotely illegal about posting for your jobs on the same day they fire you (or even if they'd posted them before they fired you).

Depending on the exact wording of your contract, you MIGHT be able to force them to buy out the remaining time on the contract, but that's something you'll have to take up with the temp agency and is a long shot at best.

I didn't complain. They asked my opinion.

This time I didn't hold back and decided to speak my mind about my boss. You may not have have approached them to complain but when they asked you, you certainly did.

This is supposed to be a forum of legal advice NOT legal opinion...

Do you all just sit at the computer and salivate till the next post comes up. Certainly there are more important things to do with your life than increase your post count. Unless you KNOW then don't answer. If I want an OPINION then I will seek the LEGAL OPINION board. Certaily if you two (Beth and CBG) are so blessed with all this legal know how then why aren't you in a court room somewhere rather than here???

As for you BelizeBreeze (lame name btw) you can kiss my ass... Again, I ask for advice and I get opinion... Maybe I should just go ask a real lawyer.

Actually, I DO know. The fact that the answer you got is not the one you want to hear, doesn't make it incorrect.

By all means, ask an attorney in your area. If you've told us everything, he'll tell you the same thing we did.

Please do see a "real" lawyer. I'm sure he or she would be more than happy to accept a fee to tell you exactly what you've been told here by three posters for free.

You know Belize and cbg, I think this site should require posters to advise along with their State whether or not they're going to turn into massive jerks if they're not told what they want to hear. Then we can just avoid those posts altogether since they don't care about what the law says to begin with. :rolleyes:

Are there any REAL attorney's on this board??? Or do you all just take the questions and post them in Google and see what you get.

CBG...you can't possibly run a business and and family and spend your every waking minute on here... It's just not possible. C'mon...tell the truth... you're divorced...you're children hate you and you probably live in a motel.

Ok Beth...you moron...

The fact is, I did see a lawyer already and I DO have a case. The temp company that I worked for broke contract and then advised my wife (without them knowing she was my wife) that I was fired. I will be suing and I will (according to my lawyer) win.

Now, why don't all of you go join the HOW TO BE A MORON board and give advice on that. You guys are professionals!
