What is the name of your state? California My X has been letting my 16 yr old daughter sleep with her boyfriend in her house as well as his mother letting them sleep together in her house. I am wondering what my legal rights are in this matter as I have a 13 yr old daughter at home still that I don't want to end up in this situation. I have 50/50 custody of my 13 yr old but my 16 yr old decided to move back into her moms house full time because I don't agree with all this and I set down rules for her to abide by. I really want to have this woman declared unfit and have both of my kids live under my roof. What are you're thoughts on this?

Oh boy! I would suggest calling the police department or magistrate and asking what the legal age of consent is in your state. If its not 16 (in some its 17) thats statutory rape, and I am thinking they could charge mom with contributing to the deliquency of a minor or aiding and abetting. If thats the case, unfit wouldn't be too hard to prove.

If the legal age is 16 then she isn't helping to break any laws, but I think this might fall under one of the few moral issues a judge might consider for a change of custody. BUt that is just an opinion.

We have joint legal custody, with her having physical custody of her at this time.

I have been through 3 custody battles with this woman. There is no talking to her. Been to court ordered mediation for which she talked over everyone 3 times. Everytime I turn around she takes me to court for child support issues for which she has lost all but the last one for child support for the 16 yr old. I am really at the end of my rope. I get no positive response from the court system in our area since they are all jammed up and can't really focus or have the time to consider all the aspects of this case.

But as a parent wouldn't you rather know what your teenager is doing so you can protect them?I know that I will.As mad as you may be at Mom for allowing this to go on,wouldn't you feel alot worse if neither of you knew and became Grandparents before you were ready?Think of it this way,she would find a way to do it regardless,believe me,I did!I know that when my kids are old enough to start thinking along those lines I will want to know,that way I can help to protect them and educate them.It's the year 2002,you can't expect her to remain a virgin forever.At least you know,knowledge is power,now use it to protect you daughter.Don't blame her mom because she is trying.
