Legally speaking, it does somewhat involve me. I'm the one who's probably going to end up getting a few nasty texts in a few hours accusing me of kidnapping. Then the cops will call me for a third time (or they could show up here, had that happen once) questioning me about kidnapping my nephew. All he wanted was a little advice on the situation. I told him I would ask around. Forgive me for trying to help him figure out if the daycare provider had a legal right to ban him from the property.

Yes. Because I'm not here to bash the providers business or claim they run a poor facility. I know she has a state issued license. Pre-school or daycare, I don't know. I only know she has some type of license because she shut her daycare down for a few day a year or so ago because one of the kids had the flu. She said they were required by the state to close down and disinfect everything. I don't know if her having a license or not is a pertinent issue.

And, for the record, I'm not here to complain about her business. Every time I have been there the children seemed very happy, busy with activities and well looked after. I'm not claiming she runs a terrible daycare nor did my brother. The only issue he had was if she could legally forbid him from picking up his child. Had he threatened her with physical harm I could understand her not wanting him there. He made a joking comment six or eight months ago that his truck smelled like dog poo that didn't even mention her.

Gee... Guess I should have been more clear. She's called the cops on me three separate times accusing me of kidnapping. Once after she left my nephew with me and twice when she called me and asked me to pick him up from daycare. Each and every time I had to explain I never kidnapped anyone. I'd prefer not to be accused of kidnapping again which is one of the reasons I asked if what the daycare provider is doing is legal.

After the last time the cops showed up to question me for kidnapping my nephew I refused to pick him up ever again for anyone. I did pick him up today because I'm the only person still on the list who could. I'd prefer not to be involved, hence my question... Is what the daycare provider doing legal? If so, fine. I'll pick him up and be accused of kidnapping every time. If not, fine. I can let him know it's not legal and he can pick up his own kid.

In all seriousness - tell your brother to deal with the dog poo HE stepped in himself and has been dragging the rest of you through.

I'm curious - why would he not stop and clean off the kid's shoes off when he first realized there was an issue? It seems kind of... stupid... to drive the whole way with the stink. And, I guess I'd be annoyed if someone intimated that I was at fault for it - someone likely did not clean up after their dog, and the kid stepped in it between the front door and the car. And yes, it *could* affect the business.

Day care or pre-school - it is not school. What she calls it makes little difference.

Has he actually spoken to the provider since she blew up? Maybe he should call her and deal with the situation like a man.

And no, Mom does not have to leave his family members on the pick-up list, unless it is court-ordered.

If both parents have joint LEGAL custody, then DAD could leave his family on the list.

Reality is that dad should apologize.

BTW, what do the court orders say? If it is to pickup from daycare and provider won't allow, then have dad petition the courts to change providers and learn to keep his mouth shut.
