    Arizona Vs. Miranda Statement supression

Well if the "victim" in this case was actually a child. Nothing more than the usual fling that happens all the time. There is less than 5 years between them, this happens ALL THE TIME. Just in this case someone got mad. lol. But since it's in a different county than i'm used to, guess they...

    Cooperation with Investigation

I would definately suggest IF he does talk to them to have an attorney with them. but NO he does NOT have to talk to them especially if he IS the suspect. If not I wouldn't worry so much about it.

    unconstitutional dui law

USUALLY only if its a felony warrant. Do you have more than one DUI arrest? In MO three or more are felony.

    Arizona Vs. Miranda Statement supression

I figured CA would be a LOT more liberal than little ole Missouri.....we have the new MO Vs. Seibert case on the books now...lol

    Arizona Vs. Miranda Statement supression

that was the point i was trying to get at. The age and experiance with the police has to be taken in account. The original suspect in this case has NEVER dealt with the police. At the most he has had a speeding ticket. I have NEVER had anyone walk out of a interview...but i HAVE had the more...

accused of shoplifting, didn't do it.

yes I agree...as long as they leave the store with it...thats all it takes here...but as far as police are concerned....all they have to do is conceal it from the rightful owner.....

accused of shoplifting, didn't do it.

If you now have to take a class was you convicted in a juvenile court? IF that is what really happened I personally would take it to the end and stick with my story.....don't allow a juvenile detective or whomever make you change your mind. GENERALLY the store personnel FOLLOW you around...

    Arizona Vs. Miranda Statement supression

From my hours and hours of reading on the topic I have come to the conclusion there are no exact answers. Custodial comes from a feeling of "not free to leave" EVEN IF he WAS allowed to leave. A LOT of deciding factors come into play: 1. Location of interview (basement, could someone who...

What exactly is a, "MOTION IN LIMINE" mean?

I THINK to "stop or preclude" statements from being made or stopping testimony. At least in a court setting.

    Question of Confidentiality (URGENT)

In MO all the cases become public record once the prosecutor "files" the charges. And I agree with CdwJava IF it's her car that gives her legal right to know...in MO you would have lost your license, and they would have been calling your mother to see where she wanted it towed!

Shopping Mall : Assaulted And Detained

lol...I don't think i'm even going to go there.....ALL i'll say is they had the right to detain...you had NO right to assault, nor resist arrest.....EVER EVEN if the arrest is unlawful. Thats what courts are for! Your OWN actions are why you were detained for two hours, and why it took so...

must a search warrant be 100% correct?

Same way in MO...If the search warrant is incorrect we don't even move on them. We have them reviewed by several different persons before they are executed. This is a LARGE mistake on LE part and everything found would/should be thrown out (at least in MO). And I would think even a public...

    ?????

In Missouri: Misdemeanor amount (less than $500) is one year Felony amount (more than $500) is three years.
