the issue at hand is the bar being raised too high, not too low. Basically it states that clearance is 6'6 but the bar is at 6'8 - 7', thus giving the person a wrong "reading" and sense of security as they pass until they come to a point where its really 6'6 and damage occurs to their vehicle...
my question is though, lets say the bar states the clearance is 6'6, does the bar have to be specifically at 6'6? or does it have to be higher?
It would be great if you could point me to the actual law that talks about that, I wasn't able to come up with anything..

After reading your post I went back to the initial one and agree with you 100%, I was wrong..
Out of pity I did some research on PE, and it is not necessarily caused by an accident of some sort, so your best bet is to try and prove that the condition was already there..
i have enough understanding of the law to tell you to start lifting weights because look you WERE driving drunk, in an accident, and somebody died. Period.

Have you spoken with the witnesses/officer who took the report? I'd speak to the officer first.. then if he says the witnesses backed up the other guy's story - speak with the witnesses.
if they backed up his story you're out of luck....
Just because he was skidding "low" doesn't make him at fault - he was still within reasonable distance for your wife to notice him. next time advise her to inspect the WHOLE street not just 6 feet up.
