While, I am not an attorney, I think this family member is going to have a tough time convincing a court it was innocent. Why not have the family member with good credit get the credit card and make the other an authorized user? That is the legal way to go about it.- cmorris

Need to get off Ex's Cards
Are you an authorized user or a joint cardholder? If you are sure you were only an AU, he lied to you. I know of no creditor that won't take off an AU--they are not responsible for payment. Send a dispute to the credit bureaus stating it is not yours. Send it certified mail return receipt.- cmorris

Forgot to sign Cease and Desist letter
Actually, I agree that the cease and desist does not need to be signed. If the important information is in the letter (e.g., account number, name, address, phone number, etc), there is no need for a signatute. The Fair Debt Collection Practices Act does not require it and doesn't even mention it.- cmorris

The debt has been charged off. That means the creditor does not believe they will collect the money. If it is assigned to a collection agency, you MAY be able to get them (originsl creditor) to take it back. If they sold it, you will deal with the collection agency. creditboards.com The C and D letter is very simple. If you want them to not call, tell them to only contact you by mail. If you want no contact, tell them so! Send it certified mail, return receipt.- cmorris

It goes against the merchant's agreement. As far as I know, the credit card companies don't make exceptions. Some places try to get by with it until they are reported.- cmorris

As soon as Visa, Mastercard, Discover, or American Express find out, you will not be allowed to accept credit cards anymore. It is against their policy. If you want to accept credit cards as a small business owner, that is part of your expense.- cmorris

Changing the name of the collection agency (or selling the debt) should not affect when this comes off of your credit report. That is based on the date of last activity. I would send a demand letter, certified mail return receipt. Tell him you are requesting the loan to be paid in full. If he doesn't by XX-XX-2005, you will persue appropriate legal action. Have you actually read anything from the FTC? Case law? Talked to others who have brought suit WITHOUT the necessary paper trail? That didn't bring the error(s) to the offender's attention? Ever heard of bonafide error? YOU NEED A PAPER TRAIL!- cmorris

Lawsuits are always a LAST resort. I'm sorry you didn't see the relevance of my questions, but it determines how I think you should proceed. On your old credit reports, does it show the correct date of last activity? If so (it should), send copies--not the originals--to the credit bureau(s)...- cmorris
