Massachusetts**************. I got assaulted at work and physically got hit, i defended my self and got fired.... Prior to my assault the same employee got into a physically altercation with another coworker he defended him self and didnt get fired. So why did I get my unemployment benefits get denied are we not allowed to defend ourselves?

But the guy you fought with was also fired right?

Yes this time he was but first time he got a warning

Shouldnt I have got a warning , shouldn't a similar situation be dealt with in the same fashion.... Am I not allowed to defend my self if I feel my life was threatened?

Every situation is different and apparently, the first altercation your co-worker got in warranted just a warning. Apparently, the next altercation he got into warranted not only his firing but yours also. This isn't elementary school. Your former employer doesn't have to give you a warning if he feels you should be fired. You're old enough to know better than to solve your problems with fighting. Grow up.

In your other threads you said you'd gotten a warning but still got into another altercation afterwards and got fired.

You also said you'd applied for UI and you were denied benefits and so you appealed. And when asked about the results of your appeal, you refused to answer.

And somehow all this happened within the last four days.

You really need to get your story straight. You also need to keep all of your posts in one thread. Changing stories and multiple threads = poor credibility.

If you are "ASSAULTED!!!" at work, you may call the police and press charges against your co worker. But just because you got assaulted at work and then terminated (for defending yourself, of course!) does not mean you are supposed to be automatically approved for unemployment benefits. Unemployment benefits are all about whether you are out of work through no fault of your own, and did you know that your actions would likely result in your termination. And then there's the fact that your employer could fire you for any reason they want to, legally, pretty much. If you are a person who has a lot of issue with co workers, even just one, and you really just had to continue the trouble and you just had to defend yourself when assaulted, perhaps contributed to the drama, they sure can fire you and due to the facts, you may not be approved.
