I need some help with info. on parole revocation law in California!!!!!!!!!!! My boyfriend has been in custody since Oct. 10th, 2004 on a parole violation, for failing to report to his parole officer. He has not yet seen the parole board, his P.O. or anyone for that matter.
I have been told he needs to be adjudicated with in 35 days and Iv'e also heard an additional 45 days is given before the inmate is released. Is this so? What are the laws in right to speedy hearing? Does it apply to this case? If any one has any info on this or any websites I can go to I would SOOOOOOOOOO appreciate it. I have a 2 yr old son who misses his daddy. We need him home ASAP

Have you called his parole office to ask?

Also, you ARE going to encourage him to run straight and narrow in the future, right? This IS his fault, after all.

I have called his parole officer left messages weekly for the past three months, called the P.Os superviser and have NEVER gotten a call back. The boy is in prison for shoplifting when he was younger as well as fraud. He takes responsibility for this and has paid his debt to society as well as done his time for this.
He is at The California Institution for Men in Chino, which is more like ALCATRAZ or Death Row. He has not been allowed to make one collect call to his family, P.O, or even an attorney which is his right. No one has given him any information or has met with him on the violation. He just was able to get some of my letters and paper supplies last week,which I sent daily.Untill now we have had no communication. He wrote me on toilet paper and gave his lunches away for stamped envelopes.
I'm all for do the crime do the time, but his rights are being violated!Inhumane treatment to say the least. When a man can't get a tube of toothpaste and a deoderant stick because the prisons are so backlogged and overcrowded So,there way behind handing out mail and money orders, the C.D.C. has a major problem!

I did some internet research. I've attached the link to contact the Office of the Ombudsman at Chino. I suggest you contact him/her regarding this disgraceful situation:

Nanall, Great feedback on this post! I looked at the link and agree it's a very good start to help this lady out. If this is indeed happening to this guy, it should be brought to someone's attention.

I sent a lengthy email to the site you gave me. I told them I want an explanation of what is happening to him and why he is being treated so poorly before he has even been convicted of a parole violation. Ilet them know if I again go ignored, I will hire an attorney for violating his rights. Habeas corpus is being filed.

Additionally, it appears that the 35 day changes may not be fully in place until July 2005. I know from personal experience that it is often delayed at this point ... and much of time because the parolees witnesses are not available to be served (sometimes because they are serving time in other institutions ... so the delay is at the request of the parolee).

Thank you, Carl, for providing the additional information to help her. This is atrocity! I can't believe this guy has been sitting in jail for three months without the benefit of a hearing. I am sure this is happening all over our country, and people have absolutely no idea who to turn to for help. I just discovered this website, and have receive a lot of valuable information. This website is addictive..

my husband has been incarcerated for about 2 months now, with no parole hearing. he was transfered to Tracy which is a prison facility, and i haven't been able to talk to him since. it has been about 31/2 weeks now.
since this whole experience, i have learned that this is an ongoing problem in the California Parole system.
there are many that are worse off than yours and mine.

I finally got some help today!

Yes, I too have learned that Governor Swartzenegger has a huge problem with parole/prisons in California. Gabe was also at tracy for a month and a half too. This is a toll free # for attorneys that assist in wrongful cases as well as right to a speedy hearing or trial. They are calling my boyfriends Parole Officer tomorrow and demanding his release or charges could be filed agaist them for violating his rights. You don't have to pay a retainer. They look into the case and tell you your options then you can decide. GOOD LUCK!
All you can do is stand by him and be sure to write. A letter is like gold when your inside that hell hole.

Most parole violators waive their right to a hearing and accept an offer of less than the one-year maximum from the parole officer at the "screening." Are you sure that has not already happened?

Yes, positive he has not even been to screening or seen anyone about waiving his rights. It seems like he has either been overlooked or forgotten about.

Hi, thanks for letting me know that there may still be hope yet, Did your husband end up having a parole revocation hearing? How much time had he served before he was released? Do you know anything about the time California is allowed before an inmate must be brought before the parole board?
