The way I see it and my parents agree is that if children's services don't think that I should lose custody that neither will a judge. That may be wrong but doesn't it make some sense.

Oh dear god. In your situation, I'd recommend following the court order EXACTLY and actually showing up for drug testing when ordered to do so.

So does that mean that you think that I wouldn't lose custody?

yes dad can get custody

you should worry-you violated a court order. and yes, the judge can give dad custody simply because YOU are denying dad his vistation time.if you want to keep custody, your best bet is to obey the order. and btw, keep your parents out of this, they are not parties to this, and its none of their business, this is between you and your ex only.

My daughter lives with my parents right now until I finish my case plan with DFCS which I will have done by june 10. Why wouldn't they have say in this.

Of course you could. You've repeatedly denied visitation that was court ordered. The child was removed by your home by DCFS because you refused to follow a court order to drop a sample. Dad wouldn't have to go to far at this point to prove you unfit.

They don't have a say in it because they're not party to the court order. Dad gets visitation as stated in the order unless and until the order is changed. Doesn't matter who the chlid lives with, doesn't matter what the child wants, doesn't matter what YOU want.

So the fact that my parents had to help me care for her when he wasn't paying child support and that dfcs has to deal with them wouldn't that help in my testimony to the judge. I didn't fail the drug screen I just didn't show up. Their words would really help me. They have the safety plan because I did not lose custody. I assigned it to them. I think that this is all just coming from his wife. They call me every weekend to get my daughter. I usually let her go I can't help it if my daughter doesn't like to stay with her dad. It's always been this way and I don't see how a judge would decide that changing a routine that a 5 year old has had for the past 3 years would be in her best interest. like I said, DFCS didn't think that I should lose custody or they would have taken it already. This is not the first time that his wife has tried to get me into trouble I had a 6 month case last year because she wants custody of my daughter and made a report against me. I am trying to work and support my daughter. I can't be called out of work all the time to go and take some stupid drug test for no reason. I think that he just wants to get out of paying me child support because that is always what he says. "I am paying my child support so I should get to see her" why can't he say I love my daughter I want to see her but I don't want to make her uncomfortable.

Darlin' - you're putting way too little emphasis on your not showing up for a drug test. They don't give those randomly. The fact that you blew it off is going to be a huge negative in your column.
