What is the name of your state? massachusetts

Can I keep the $4200. dollars that my bank deposited (more than three months ago) into my checking account?

What could they do to me if I used it to pay a debt?

I heard about a guy going to jail, but his case was for half a million dollars.

Mine is obviously much less than that.
A co-worker had this happen to him a long time ago, he used it after a year. His was for 5000.

Yes, I know the RIGHT thing to do, my question is, what are the laws? I am desperate to pay this bill that is making my life a living hell.

No you CANNOT keep it, morally or LEGALLY. You cannot profit from a mistake. Inform the bank or watch them take it out when they realize the mistake.

Thank you for the advise,

I was hoping I could keep it, but if there is a law saying I legally cannot than I won't. As for morally, they are a faceless huge corporation and I'm sure if table was turned, they would not give it back to me. They would rip me off in a heart beat.

regardless of "faceless corporation", what goes around-comes around. Do the right thing. If you didn't earn it, you can't keep it.

Just means you are ripping off alot of folks instead of one. Still not right, But I see you don't care about that.

And no, they would not rip you off if they had the chance. They are in business and have many customers because they are honest.

regarless though, legally you can not keep it, so just give it back and pretent it came from the goodness of your heart, maybe the "honest bank" will give you t-****

I always find it amusing when people think an entity is evil and dishonest simply because it has or controls large sums of money, therefore usually trying to justify thier own dishonest activities.

Oh, I bet you do! AverageJoe1982 is trying to also.

So, this is supposed to somehow invalidate my point?

Maybe the bank is only dishonest behind YOUR teller window.

But If I had to guess, I would think you are more of a custodian or security gaurd kind of guy.

Screw what other people think. You do what you feel is morally correct.

Legally you need to inform the bank of the erroneous deposit.

If you decide that you wish to use it, then be prepared for the bank to take the money back when the accountants discover the mistake. Immediately.

Years ago the bank put $2000 that was not mine in my account. I just let it sit there to see what would happen. About 6 months later, they realized their mistake and took the money back out. I don't think you have an obligation to tell them about their mistake, but you can be sure they are going to come and get the money at some point, and if you used it, you'll be in trouble. Better just tell them and avoid the temptation.
