Car Accident 1998 - CASE STILL NOT DONE!! HELP

What is the name of your state? NEW YORK

In 1998 [February] I was in a car accident, we were double parked and a van rammed into us from the front, while bouncing off of two double parke dvehicles on the other side of the street going in the opposite direction -kept on going, driver ran off was found later -claimed that he was not the driver, his sister filed the car stolen 3 days later I believe... totalling our car aloing with me in it - fractured spinal cord L2-L5.9 week hopitalization.., Police reports were filed and we sued right away all the involved vehicles. I was 15 at the time, and it has been 7 years. AND THE CASE IS STILL NOT FINISHED

The case has been running for these 7 years, question: is it possible for such a case to run for so long? (original judge dealing with my case died, have a new judge)

Also, we are currently suing for 'acting in bad faith', we spoke with the other insurance co's to come to a settlement considering theat it has been so long, all the settlements were reasonable and the co's refused without good reason. HOW DOES THIS WORK?

I have all these questions because I have very minimal communication with my lawyer, is it possible for the case to be closed without my consent???

A: Your lawyer has all the answers. You need to make sure you have maximum communication with that lawyer, starting today. Call and insist on a appointment as soon as you finish reading this sentence.

yes i try.. I call him and leave messages.. I can go to his office, when I see him what questions should I ask.. and Is it possible for the case to be running for so long??

Not very hard....Go camp out in his office till he answers all your questions. Be politce....

YOU ARE VERY RUDE AND OF NO HELP WHATS SO EVER.. If you do not KNOW the answer to my question, which my Lawyer will definately not have an answer to, PLEASE do not reply at all.

I am not rude and if your lawyer will not know the answer to your question, then how would expect anyone else on this forum to know the answer to your question?

If you weren't in NY and I wasn't In California. I would say we have the same
Lawyer!
Mine does not answer phone calls either!
The Judge is never Rude. (except maybe when talking "dirty" on the Real Estate forum. :p ) He is using common sense.
It is pretty much impossible to answer your questions and that is what he is saying. You need to talk to your lawyer.
The crystal balls on this website are always broken. :p

I know myself when I asked about my accident... There are so many variables. You could never imagine.
So don't get a big ol chip on your shoulder... especially not against the Judge.
If you want to see RUDE... oy... just keep up the 'Tude and you will get some
real RUDE, bud.

Wow. And here I was just about to answer all your questions when you had to go and pop off like that. Since I do not like rude people either, I'm afraid you're back to square one and waiting even longer for your answers. Good luck.

Seems very rude to me, I am sorry if it does. My question was simple: would it be possible for my case to be settled without my consent due to the fact that my lawyer is so 'unreachable'..

I apolagise .. and I got in touch with my lawyer the ball is still rolling.. Im just very uneasy it's been 7 years. :(

Yes, I am afraid it is possible for your case to be settled without your knowledge, but it wouldn't be without your consent (necessarily) because that would depend on what your contract with the lawyer said.

That is why I was so insistent that you talk to your lawyer.

Only your lawyer knows the answer; all I can do is guess.

I was in a car wreck last year with my two children. The at fault insurance company has informed me that I have a two year statute of limitation for my settlement/or suit while my children have up to two years AFTER they turn 18.

I was told that in my daughter's case, any settlement she might get from them would have to be approved by a judge if we agree to settle before her 18th birthday as she can come back and sue them once she turns 18. She had a head injury and I think they are just covering all bases.

Is it possible that your parents or attorney settled on your behalf before you turned 18?

You can't sue the other insurance co. f/ bad faith as you have no contract w/ them. You also can't sue them f/ bad faith just b/c they refuse to settle w/ you. My question is how stupid is this lawyer you got? Any atty w/ half a brain knows you can't sue f/ bad faith unless you are sueing your own insurance co. Even these cases are hard to win. Your insurance co. would have to do something that violates the contract you have w/ them. Actually anyone can sue anybody f/ anything. You just won't win.

My guess is you've been screwed by a PI atty. Next time don't double park. People hate jerks like you.
