Contempt

What is the name of your state? California

What happens if you FTA at a contempt hearing for child support?? An OSC for contempt was personally served for failure to pay and failure to notify DCSS of a change in address. Will they issue a Bench warrent??

Are bench warrents served in other counties??
For example; bench warrent issued at court in county1, person whom bench warrent is for lives in county2 if person gets stopped by police in county2 will they arrest them?? If they do, will they site release them or transport them to county1 for court??

My response:

Warrants are enforceable all over the country. Once a warrant is issued in County A, State A, you can be arrested in County B, State Z.

You can run, but you can't hide.

IAAL was kind enough to give you an answer, though I'm sure it wasn't the one you wanted. Just curious, why are you running, or shoud I say avoiding financial obligations to your child/children?

And you know that it's OP avoiding financial obligations.... how, exactly? Or are you assuming?

Is my face red? You're right. After reviewing first post, I see where I definitely made an assumption. I'm sure CP realized my mistake though I still apologize.

Sorry I intentionally left the post general, because I am the bitter angry step mom who is seeking revenge of my SD BM through child support. But in my defense I must say I give freely of my self and my money to support my SD and my anger towards her mother is not actually motivated by money, it is because of her total lack of care and commitment to her child. If I could force her in to court and make her care for her child emotionally I (and I say *I* because like it or not although I have no rights as a step mom, I am the one SD comes and cries about why doesn't my mom call me...) I would, but since that is not possible my husband has chosen to persue her through CS. If SD can't have her emotional support, she atl east deserves her financial support.

And no offense taken about me skipping out on my obligations, I am glad people are anti-deadbeat parents. It just happens I am not one of them.

I also do not wish jail on BM but I wanted to know what might happen if she failed to appear, because it took DH over a year to get her address and if they have to serve her again it might be difficult.

Are you speaking specific to CA law? This one's got me really curious because bench warrants here in PA are only applicable to PA. Believe me, I've just lived that 9 month nightmare of tracking the deadbeat down. He has subsequently been arrested twice and I'm curious to see what my next steps would be should he in fact move out of state.

P.S. OP, please forgive me. I hope I'm not hijacking your thread. Just curious to read IAAL's response.

Contempt and the mis-issued bench warrent-Update

**No question just a quick update**
The contempt hearing was today and instead of going after the mother who owed the judge assumed it must be my husband (the father) who owes. My husband was not in court, because DCSS said he did not have to be, but our friend was there spying for us. He called frantic and said they just issued a bench warrent for my hubby. Hubby rushed down there and got in front of the judge.

Judge laid into him about how he owed $11,000+ and he was legally obligated to support his child, my hubby tried to interupt him but you know how judges hate that, so when he was all finished ripping my husband a new one, my husband calmly said must be confused or mistaken because he has had full custody of his daughter for over three years and in that time has paid 100% of her support. He explained that he has a good union job which provides her with health benefits and then he told the judge that if he wanted to scold someone about not supporting daughter that maybe he should talk to her mother because she is the one who has not seen her in over a year and not sent one dime of support in the 3+ years that she has been with me, not any child support , not any school clothes or school supplies, not even a birthday or christmas present.

The judge apologized profusely and said he had just assumed that my husband must have been the obligator. This sent my husband off again, he said oh, so you stereotyped me, it is those stereotypes that made it so hard for me to get custody of my daughter even though she was being abused at her mothers, and now I have full custody and have done nothing but right by her and you are still trying to prosecute me!

DH said after court people were coming up to him telling him what a good job he did/is doing.

Hopefully they got the bench warrent out of the system.

Congrats to your husband. I'm glad to hear that he spoke up for himself too in front of the judge.

Funny, we never did hear back from IAAL regard the enforcement of the bench warrant. I'm thinking there really are NO attorneys on this site; just people who profess to be. No matter. I would just follow up and make sure they don't have any warrants on the books for your husband. You know how "wonderfully" effecient the system is. :rolleyes: NOT!!!

Congrats!! Now, are they going to go after the ex?
