I’m working as a contractor for an IT firm and my contract ends on April 4 2015. The company wants to bring me on as a full time employee but they claim they can’t do that until sometime after April and don’t know when this will happen. Currently I’m considered a limited time employee with full benefits. They want me to continue to work without a contract until they can get their act together and come up with a way to bring me on as a full time employee. My question is what is the legal responsibility of the company if I do stay on without a contract?

those two statements are mutually exclusive.

unless the "employee" part you are speaking of a company other than the IT firm that is considering hiring you.

I'm in Florida. The contract I'm working under includes benifits as if I'm a full time employee and it's called a limited time employee contract that gets renewed each year on April 4.

Do you get a W-2?

Yes I get a W-2. I got the job when the company that had the contract the first 3 years was under bid by the company I'm working for now. The new company had to take us on because the contracting company did not want them to bring in new people and have to retrain them.

if you get a w-2 you are not an independent contractor. You are an employee. You are apparently an employee with a finite term of employment but it appears they are considering you an employee.



My question is what is the legal responsibility of the company if I do stay on without a contract?
pay you when you work however much you and they have agreed you would be paid. Other than that; not really much.
