I called up to the states attorneys office this morning and the woman who I spoke to told me they were still working cases from back in May and it could take a couple of months before my report/case is even looked at, so I don't even know what to do about the criminal complaint against me because I don't know what they plan to do.

When is your court date? The DA should be prepared at that point. She might just drop the trivial charges altogether. (What was the charge BTW?)

Then go find yourself a lawyer because I personally believe the arrest was in error and shouldn't have happened. Might get a settlement. The arrested you for driving down a road past some womans house you don't even know. Not menacing in any way, just driving.

If that is not a false arrest I don't know what is.

Did you get to post bail in a few hours, or did they hold you overnight?

I may be overstepping my bounds, because I am not a lawyer, but that is definitely what I would do.

Did he ever make his deliveries that day at that time on that street? or were the deliveries made earlier in the day or by someone else?

I have not been given a court date, and I paid the bond within an hour of the arrest. The charge is "disorderly conduct" and the officer said the reason why is because I drove by her home to harass her, even though I told him why I was going down that road. He just didn't care.

My release paper from the jail says I will be mailed a court date, and has a bond condition that says I may not have any contact with the individual, including driving on this public road, or I will be arrested and held without bond... Not that this is a problem because I don't even know her!

I made the delivery for my dad because he wanted to avoid this area for this day and have me go down there since she didn't know me and didn't suspect that she would do anything about me driving past. I have the video from my phone of my drive past her home if you would like I post it here... It clearly shows all I did was drive by, nothing said, nothing done, just recorded my drive to see if she came out with the camera, or tried to say I might have done something since my dad has had problems in the past.

What it also shows is you were driving past her house recording her. Might be harrassment, or disorderly conduct.

According to the attorney I called, and the Master Sargent at the State Police office here, video taping my drive past her home is not illegal and isn't harassment, unless she has advised me not to do it and I did anyway. She was not outside at the time I drove by, and it was about 6:30-7:00 AM roughly. I don't think she even knew I recorded it, or that I had even gone by until her motion sensors along the road alerted her I drove by, but none the less this woman didn't know me, didn't know what I was driving down there for, so she shouldn't have even worried one bit about me driving by, but... she did.

As for these motion sensors, they look like infrared sensors that you see on motion lights on houses, on little poles about 2' from the road. There are 3 of them, one where her property begins, one near the driveway, and the last is where her property ends, along the road.

Yea, that I've come to find out, unless I can prove the officer arrested me without any probable cause, and did so in a violation of my rights... according to the attorney. He said the one you would sue would be the woman who filed the complaint. I don't really care about the money but I do think someone should do something to make her stop.

I have contacted a member of the local media whom I know and got more information about the complaint that he read for his news report.

She claims I drove by at an earlier point of the morning, made an obscene gesture, left, returned later to harass her. Heh, wow this is great, and she claims to have it all on video. I can't wait for this video because I have only been on that road once in maybe 4 months, and that is the time I recorded my drive past, and was arrested for.

She is clearly making a false claim against me, and if she has video proof, that will be enough to prove I did nothing wrong.

Sweet.

Defamation of character suit.

I'd want to get that lady too.

Good luck, I hope you are able to conclude this incident with a desired result. :)

Would this all be handled by a civil rights attorney, or is there someone in a specific field I should consult?

Should the attorney expect payment before taking the case, or should it be handled by a certin percentage of a settlement if any? I would go as much as 50% to get someone to handle this case, just need to know what my options are for finding an attorney.

Well, I've checked in with the Prosecutor's office and they still don't know what they are going to do. No court date has been filed and I'm just laying in wait. The woman told me it could take weeks, even months before they decide what to do since they are understaffed.

I'm positive that if they do decide to try and prosecute me I will win this as the evidence on both sides will show her accusation to be false.

I contacted a few of the neighbors in her area and many of them have said they would testify that they too have had problems with this woman in the past. Some of those problems include the woman following them when they drive past her home, using a spot-light to "tag" their car at night when they drive by, yelling at them from her yard as they drive by, standing by the road video-taping them as they drive by, and one boy said he rode past on his 4-wheeler and her husband chased him down and told them the road was private and he was no long allowed to ride his 4-wheeler there anymore.

I have checked with the township and the road is still a public road, and even the township commissioner has commented about people complaining to him about this woman telling people it's a private road and no through traffic is allowed.

I have not been back down this road, and neither has my father all to avoid any more troubles with this woman.

The attorney I have spoke with said I need to wait until the States Attorney has decided what he is going to do, and if they drop the charges, or I win the "Disorderly Conduct" case then he would be willing to help in the case with the false accusation, my arrest, jail time, the cop contacting the place my contract is with (possibly to lose my contract), and whatever else might come to light.

I'm still curious what others might think about this whole ordeal. I still feel like I was treated unfairly, and after hearing what her complaint alleges I feel something must be done.

Do you not understand the obvious fact that this lady is NUTS and she COMPLETELY BELIEVES what she is saying to be true? She isn't intentionally lying or trying to harass you. She's CRAZY. If she's not intentionally lying, then there's no defamation (she would have to KNOWINGLY state falsehoods). Defend yourself against the charges, but for heaven's sake don't bait the crazy lady! It's a fight you can't win because the other side doesn't understand the rules.
