In some areas, schools only provide services once the child is actually in school. Some areas do not offer services in kindergarten because it is not required. If you are low income, you can get services prior to enrolling through school, but many of those programs have been cut so there are long wait lists. So you cannot assume that the school will offer services at this point. They are right in helping their child as early as they can, provided their budget allows it.

I will also add the OT report deemed his therapy medically necessary but his mom refuses to pay half because she doesn’t believe anything is wrong so kinderprep at his daycare is all he gets
Then you are being neglectful and should have taken mom back to court for contempt after you got him the OT he needed.

And OP the fact that I agree with LD is enough to make me really resent the fact that you want to complain about him needing OT but have done nothing to attempt to obtain it other than gripe about mom not following the court order that you have done nothing to enforce.

A child receiving educational services is not necessarily academically limited. My child with a 160 IQ and now a PhD received services in elementary school. Another child with a medical issue was misdiagnosed as only LD and never received proper health care services. It was only when he was properly medically diagnosed did the other issues become obviously descended from the health issue; 40 years later we are still fighting a battle for him.

Please have a team - medical and educational - for your child. Be persistent! Become informed.
