by refusing to take a dna test he has not "forgone his rights". Takes alot more than that do give up your rights to something.

I mean, even if he said "I am giving up my rights to the child" and that was that, that is "hearsay" and would mean nothing in court. It was not a binding contract and there was not a signature involved...even if someone could give up their rights to a child like that.

Yes he has "forgone his rights" because he never established that he was the father of the child.

duuuuuuuuuuuuuude.... try to read this s-l-o-w-l-y, so it's easier to understand. Okaaaaaaaaay?

Dad currently has no rights. Because he has never established himself as the father. This is a pretty simple concept. Read it again. Comprehend it. Embrace it.

I am not stupid, nor am I even the least bit retarded, stealth...unlike you as you attempt to show that you are capable of humor. Which, through recent comments I do not see.

Maybe...just maybe the mother of the child should have every male in the town where she lived take a paternity test since you all seem to think she doesn't know this guy is the father. I mean, I know Maury deals with some women who think 10 different guys are the father of their children only to be told "you are not the father" but damn. Give this girl some credit.

And, wannacry person...Please do not assume you know me or my situation. Those assumptions will make me believe you are reaching for something to make your miserable life seem somewhat better. Truth is, I am on my son's birth certificate and was there from conception, to birth, to now.

Then stop acting like you are, gator. The court requires establishment of paternity. You know that. Even if Mom cried from the rooftops taht this guy is the father, that does NOT make it so by law.

I would say the heck with him unless he proves he is the father!

That is what most women want; a fatherless child. Then they can get welfare and foodstamps and most of all, that oh so delicious cheese.

How many fathers out there who are on the child's birth certificates know the child is theres? I mean, with the increase in infadelity and all. I do not see that many of them did a paternity test upon being placed on the certificate. Hey, there is a novel idea. Why not get a paternity test, from now on, to make sure the child is yours before you are put on the certificate.

You just aren't understanding the law on this one. Dad isn't the dad because he never established himself as the dad. He deliberately did this to avoid child support. The child is now three.

You are misinterpreting the law in this instance. Mom has no obligation to the putative dad whatsoever......nor can mom be charged with a felony for doing whatever she wants to do....at this point he is a legal stranger to the child. He has no rights that she can violate...and that was his choice.

you know what wannacrymeariver.........

YOU have not given any advice of substance last I checked. You have done nothing but give your opinion on matters. So, what I suggest is that you go back out, sit on your porch and watch the neighbors as they waller in the mudd a bit.

My Husband has 2 "children" but because the girls cheated and refuse to give him a PT then he has to do nothing and never will , and I am behind him 100%! Now if a PT is done and he turns out to be the dad then and only then does he have to do ANYTHING! So if the girl don't want him to have anything to do with the child and he won't prove he is the father than the heck with him!

Gurly person.

The mothers of those children cannot keep him from doing a paternity test to show he is or is not the father of those children. That is not a choice they have. He can have it done at the request of the court. That, is just HIS way of keeping from having to pay support; as someone so eloquently stated earlier.
