Found my child!!!!

What is the name of your state (only U.S. law)? NJ

I have found the mother (finally through a friend of hers) and got her number. I called her and introduced myself and she immediately hung up on me. I called again and left a message (no reply). Ithen called again and she picked up, she behan yelling andscraming at me (I could not hear a word she said). She then said "you will have to fightme in court to see my child again"..I'm willing to fight her in court andreceive the minimum visitation. All I wan to do is see my child and have my child establish a relationship with my child with my wife.

Question: She lives in another state, will I have to file in the state she reside in? Will my arreage of child support be taken once I file taxesto catch up on back child support? and lastly will she be responsible for the cost of my child coming to see me since she was the onewho moved away?

I don't even remember if you have an existing order. If so, what state was it issued from?

How long has Mom lived in new state? And do you have an ADDRESS or just a phone number? Because you can't serve a phone number.

It depends. Are you due a refund? Is it equal to or more than the arrears? How much of the refund is "owned" by your current wife, and will she file an injured spouse form in order to protect HER portion of the refund?

Probably not. She moved after you cut off contact. She has lived in a new location for quite some time, and you have made NO EFFORT until recently to visit the child.

Not only is it likely that you will be required to pay at least 1/2 of the transportation costs, it's also likely that you will have to visit in Mom's area for awhile until you've established a relationship with the child.

I dont know when she moved, I guess during the time I stopped communication and I owe quite a bit of child support that may take my refund (wife and I file together) and the court order was first initiated in NJ and she moved to washington D.C.... Will she be required to meet me half way for visits?

Probably not at first, because as someone else told you you will likely have to visit for a while in mom's community until the child gets to know you again.

If the current court order is still active NJ would still have jurisdiction. Although mom could try to fight that based on "inconvenient forum"...particularly if it would be in the child's best interest to have a GAL involved.
 
Previous conduct matters...that's what else matters! And if you don't like the criticism you get here...just imagine how you will feel when it is the judge, opposing counsel and the GAL ALL criticising you?? :eek:

My suggestion would be to crawl, on your hands and knees, and beg for forgiveness from mom and advise her you will do the utmost to play by her rules. Without complaint. Of course with a court order but give more than you ask for.

Its getting thrown in your face because you don't seem to grasp that its not so simple as "I am the dad and that is all that matters".

I will apologize to my child but not the mother. I hurt my child not the mother.
